Seniority of district cadre to be maintained by district heads, CMOs

SRINAGAR: The Jammu and Kashmir Health and Medical Education Department has issued a pivotal directive to enforce the Jammu and Kashmir Civil Services Decentralization and Recruitment Act of 2010.
The circular issued by the Health and Medical Education Department emphasizes transparent promotions, the formation of departmental promotion committees, and meticulous maintenance of seniority lists.
Attention of all the Heads of Departments/District Heads/Chief Medical Officers working under the administrative control of the Health & Medical Education Department is invited towards Jammu and Kashmir Civil Services Decentralization and Recruitment Rules-2010, notified vide SRO-375 dated 21 October 2010, by General Administration Department, UT of J&K. Rule-19, Rulee-21 and Rule-22 of the said Rules provides as under, reads the circular.
Rule-19: Promotions from District Cadre to the Divisional Cadre:- While making promotions from the District Cadre posts to the Divisional Cadre posts, the competent authority shall allocate to each District such number of posts as the ratio and proportion of the Cadre strength of each District bears to the total Cadre strength of the division concerned as far as practicable and make promotions accordingly."
Rule-21: Constitution of Departmental Promotion Committees:- There shall be constituted the following Departmental Promotion Committees for each Department comprising of the following members for considering promotion to the non-gazetted posts.
For district Cadre posts: - the head of the concerned department at the District level who shall be the Chairman of the committee; a representative of the head of the department at the Divisional level; and an officer of the concerned department, not below the rank of an Under Secretary to be nominated by the Administrative department.
Rule-22: Seniority: Every Department shall maintain a separate seniority list for each District, Divisional and the State Cadre for all category of posts Included in the respective cadres In accordance with the rules. However, despite clear directions, it has been observed that some of the HoDs/District Heads/Chief Medical Officers are not complying with the aforementioned instructions notified by the government.
Accordingly it is impressed upon all the Head of departments/District Heads/Chief Medical Officers, working under the administrative control of Health & Medical Education Department to adhere to the aforementioned rules in letter and spirit; It is also impressed that.
Henceforth the seniority of all the district cadre posts must be maintained by District Heads/Chief Medical Officers, for their respective districts, strictly as per rules.
All the District Heads/Chief Medical Officers, who shall be the Chairman of the committee, in terms of Jammu and Kashmir Civil Services Decentralization and Recruitment Rules-2010, must conduct DPC of district cadre posts at their own level.
While making promotions from the District Cadre posts to the Divisional Cadre posts, the competent authority (concerned HoD) shall allocate to each District such number of posts as the ratio and proportion of the Cadre strength of each District bears, to the total Cadre strength of the division concerned.
